Probation Period in UAE: Rules for Employees (2026)
- Probation cannot exceed 6 months and cannot be repeated for the same role.
- Employers must give 14 days written notice to terminate during probation.
- Once you pass, the probation months count toward your gratuity and leave accrual from day one.
The core rules
- Maximum 6 months — any longer is unenforceable, and you can't be put on probation twice by the same employer for the same job
- Employer termination: 14 days' written notice during probation
- You resign to join another UAE employer: 30 days' written notice (one month). Your new employer must compensate the old one for recruitment costs if stipulated
- You resign to leave the UAE: 14 days' written notice
- If you leave without proper notice, the employer can claim compensation — and a one-year employment ban was historically possible (now largely replaced by mutual agreement rules; check current MOHRE guidance)
Your rights during probation
- Salary: full agreed salary from day one — no "training wage" deductions
- End-of-service: no gratuity if total service stays under one year (the usual case in probation exits)
- Annual leave: you accrue it but most employers require completing probation before taking it
- Unfair dismissal: even in probation, termination for discriminatory reasons can be challenged
- Visa costs: the employer bears recruitment and visa costs — these cannot be deducted from you
Passing probation
Once probation ends successfully, your service is counted from your original start date — the probation months count toward your one-year gratuity threshold and leave accrual. Get written confirmation that probation is complete; some employers "forget" and the ambiguity only hurts you later.
Termination during probation: who owes what
Four common exits play out very differently. This table assumes a six-month probation and an employee who started on 1 January:
| Scenario | Notice required | Pay owed |
|---|---|---|
| Employer ends probation | 14 days, in writing | Salary to the last working day, plus accrued annual leave encashed at basic ÷ 30 per day |
| You resign to join another UAE company | 30 days (one month), in writing | Salary through the notice period; the new employer may need to reimburse recruitment costs if your contract says so |
| You resign to leave the UAE | 14 days, in writing | Salary to the last working day; no gratuity if total service is under one year |
| You walk out with no notice | None given — that is the problem | Salary earned to date, minus any compensation the employer claims for the missing notice |
Two things people get wrong: first, "no notice" does not mean "no pay" — salary for days already worked is always owed. Second, annual leave accrued during probation is payable in cash on exit at the basic-salary daily rate, even if you never took a day off. Confirm the leave balance in writing before your last day.
Extending or failing probation: your options
Your employer cannot extend probation beyond six months — the cap is absolute, and any "extension" past that point has no legal effect. If your manager asks you to sign one, you are already a confirmed employee in the eyes of the law, which means the full notice-period rules apply to any termination.
If you sense you are about to fail probation, act before the letter arrives:
- Ask for written feedback — vague verbal criticism is hard to challenge; a written record protects both sides.
- Insist on the 14-day notice in writing if termination is confirmed, and check the dates: notice runs from the day it is served, not the day of the conversation.
- Negotiate the exit wording — some employers will record a resignation instead of a termination, which reads better in future reference checks. Get the agreed last working day and final pay date in the same document.
- Collect every due — final salary, leave encashment, and any unpaid overtime, all inside your final settlement. Unpaid dues can be claimed through MOHRE.
And if you resign during probation yourself, the direction of your next move decides your notice: 30 days if you are joining another UAE employer, 14 if you are leaving the country. Serving proper notice keeps your record clean for the next visa.
Paperwork to collect on your last day
Whatever the reason for the exit, do not leave without these — each one is hard to obtain later:
- Written confirmation of your last working day and whether probation was completed or terminated
- A final payslip showing salary to the last day plus leave encashment as separate lines
- Your experience letter — the next employer's visa file will ask for it
- Written confirmation of how your work permit and visa status will be handled (keep a copy of whatever is filed)
- A receipt for any company property you returned — laptop, access card, SIM
