Gratuity: 21 days basic per year (first 5 years), 30 days after — capped at 2 years' basic
Unused leave encashed at basic ÷ 30 per day; notice pay and unpaid salary use gross salary

Gratuity — basic ÷ 30 × (21 × years up to 5 + 30 × years after 5), capped at 2 years' basic (Article 51)
Unused leave — basic ÷ 30 × unused days (Cabinet Resolution No. 1 of 2022, Article 19)

Common mistakes to avoid
Mixing basic and gross salary. Gratuity and leave encashment use basic salary; notice pay and unpaid salary use gross. Swapping them is the single most common error — see our basic vs gross explainer.
Forgetting leave encashment entirely. Unused annual leave is paid at basic ÷ 30 per day and can add thousands of dirhams. Many employees only check gratuity and leave money on the table.
Accepting the "old law" resignation cut. Some HR departments still quote the pre-2022 one-third/two-thirds rule. It was abolished — resignation pays full gratuity after one year of service.
Signing the acceptance before verifying. Once you sign a final settlement receipt, disputing the figures later is extremely difficult. Verify every line first.
Missing unpaid salary and overtime. Any salary earned but not yet paid, plus qualifying overtime (basic + 25% daytime, + 50% night 9PM–4AM), belongs in the settlement — don't let it quietly disappear.
Ignoring the 14-day clock. Article 53 gives the employer 14 days from your last working day. Mark the date and follow up in writing the moment it passes.
Pro tips
Build your own itemised sheet first. Calculate gratuity, leave, notice and unpaid salary separately with this tool, so you can challenge HR's figure line by line.
Download or screenshot everything. Keep copies of your MOHRE contract, all payslips, leave balance emails and the visa cancellation paper — you need them if a dispute reaches MOHRE.
Check your leave balance early. Ask HR for your exact unused leave days before your last week, while corrections are still easy. Read how leave salary is calculated so the number makes sense.
Time your exit. Crossing a service anniversary (especially the 5-year mark, where the rate jumps from 21 to 30 days) materially changes gratuity — a few extra weeks can be worth it.
Deduct only legitimate advances. Employers may deduct genuine salary advances or loans, but not arbitrary "fees". Ask for written proof of every deduction.
Keep your bank account open. The settlement is usually paid by bank transfer to your salary account — don't close it until the money lands and clears.
Second worked example: full settlement with leave and notice
Basic AED 7,000, gross AED 10,000, 3 years service, 12 unused leave days, 10 days unpaid salary.
Gratuity: daily = 7,000 ÷ 30 = 233.33; 3 × 21 × 233.33 = AED 14,700
Leave encashment: 12 × 233.33 = AED 2,800
Unpaid salary: 10 × (10,000 ÷ 30) = AED 3,333.33 Total settlement: AED 20,833.33 — notice how leave and unpaid salary add over AED 6,100 on top of gratuity.
Frequently asked questions
What is included in a UAE final settlement?
End-of-service gratuity, encashment of unused annual leave, notice-period pay (if notice wasn't served), and any unpaid salary — minus advances or loans you owe the employer.
How is unused annual leave encashed?
On basic salary ÷ 30 per unused leave day, under Cabinet Resolution No. 1 of 2022, Article 19.
When must the employer pay everything?
Within 14 days of the contract end date — gratuity, final salary, leave and all other dues (Article 53).
Can my employer deduct advances from the settlement?
Yes — genuine advances or loans owed to the employer can be deducted. Anything else should be questioned.
My salary has been delayed for months — is it part of the settlement?
Yes. Salary you earned but never received is claimed as "unpaid salary" (gross ÷ 30 × unpaid days) and must be included in the settlement, payable within 14 days of your contract end date. Keep your WPS salary records or bank statements as proof of the gap.
My employer paid less than this calculator shows — what should I do?
Compare your final payslip against each line of the breakdown above — most short payments come from using total salary instead of basic, or from skipping leave encashment. Raise the discrepancy in writing with your employer, and if it stays unresolved you can file a labour complaint with MOHRE.
How can I check my employer's gratuity figure is correct?
Confirm the basic salary on your MOHRE contract, apply the 21/30-day formula with a daily rate of basic ÷ 30, and make sure part years are pro-rated and the 2-year cap is applied. Run the same dates through our UAE Gratuity Calculator for a full year-by-year view.
Is overtime included in the final settlement?
Yes — qualifying overtime must be paid with your final dues. The standard rates are basic salary plus 25% for daytime overtime and plus 50% for night hours (9PM to 4AM), capped at 2 hours per day under Article 19. Keep your approved overtime records to claim it.
Can my employer withhold my settlement until I hand over company property?
Employers sometimes delay payment citing unreturned assets, but the 14-day payment rule in Article 53 still applies to your end-of-service dues. Return company property promptly and in documented condition, and insist the settlement follows the legal timeline.
What happens to my end-of-service if the company shuts down?
Employee dues rank as priority claims when a company closes or goes bankrupt — gratuity, unpaid salary and leave encashment are owed before most other creditors. File your claim with MOHRE immediately and keep every contract and payslip as evidence.
Does the final settlement include my flight ticket home?
It can. Many contracts and company policies include a repatriation ticket when employment ends, particularly for employees recruited from abroad. Check your offer letter and company policy — if it is contractual, add it to your settlement expectations.
Should I get a lawyer before signing the final settlement?
For straightforward settlements that match your own calculation, usually not necessary. But if the employer's figure differs materially, deductions look unexplained, or payment passes the 14-day deadline, a quick consultation with a UAE labour lawyer before signing is money well spent.
